NY cannabis laws (2026 edition).

The 2021 MRTA legalized adult-use cannabis. Five years later, here’s the working version: who can buy, how much, where to consume, what the cross-border rules mean for visitors. Read in 5 min.

Adults 21+ may purchase up to 3 oz flower or 24 g concentrate per day. Edible packages cap at 100mg total THC. Public consumption follows tobacco-smoking rules. NY residency not required — out-of-state IDs accepted.

NY DUI applies to any cannabis use regardless of where it was purchased. Wait 6-8 hours after edibles, 3-4 hours after inhaled before driving. Employer drug-testing rules vary; NY law restricts (but doesn’t fully prohibit) cannabis-based employment decisions.

Cannabis purchased in NY must remain in NY. Crossing into PA, NJ, federal land, or any other state is a federal Controlled Substances Act offense + applicable destination-state law. TSA can refer to law enforcement; don’t fly with cannabis.
