NY cannabis laws — the working version.

The Marijuana Regulation and Taxation Act, signed March 2021, made NY the fifteenth state to legalize adult-use cannabis. Below: the regulator, the rules, the practical implications for shoppers.

The MRTA legalized adult-use cannabis for NY adults 21+. Established the Office of Cannabis Management (OCM) as single state regulator. Created the CAURD program (Conditional Adult-Use Retail Dispensary) prioritizing equity-eligible operators for initial licenses. Built excise tax structure based on THC content + sales tax.

Per-day purchase: 3 oz flower or 24 g concentrate. Public possession: same totals. Home possession: up to 5 lb in a private residence. Edible package: 100mg total THC. Out-of-state IDs accepted; NY residency not required.

Allowed: private property where owner permits, public locations where tobacco smoking is allowed (subject to local rules). Prohibited: vehicles, schools, federal property, within sight of children, retail dispensaries themselves. Many local jurisdictions have additional restrictions.

Driving + employment + cross-border.

DUI applies to any cannabis use regardless of legal status. Wait 6-8 hours after edibles, 3-4 hours after inhaled before driving. Employer drug-testing rules vary; NY law restricts but doesn’t fully prohibit cannabis-based employment decisions. Cross-state-line cannabis transport = federal offense + applicable state law in destination state.

Adults 21+ may purchase up to 3 oz flower or 24 g concentrate per day; edibles cap at 100mg per package. Public consumption follows tobacco-smoking rules. Cross-state transport is a federal offense. Can I grow my own cannabis in NY?
Adults 21+ may grow up to 6 plants at home (3 mature + 3 immature). Same household max 12 plants regardless of number of adults living there.
Can my employer fire me for cannabis use?
NY law restricts cannabis-based employment decisions but allows them in some cases (safety-sensitive roles, federal contractors, etc.). Consult an employment lawyer if concerned.
What if I'm a federal employee?
Federal employment + federal contractor work continues to follow federal cannabis prohibition regardless of NY state legalization. Cannabis use can disqualify federal employment.
